All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region or jurisdiction.

When you place an order, you are making an offer to purchase. That's Them reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until That's Them confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting as we may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to or cancel an order, we will attempt to notify you by contacting the email, billing address or phone number provided at the time the order was made.

Your purchases are subject to return or refund solely in accordance with our Return and Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Section 4 - Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

We may offer promotions on the Services from time to time that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase and payment information for all purchases. You represent and warrant that the payment information you provide is true, correct and complete, that you are authorised to use the payment method provided, and that charges incurred will be honoured by your payment provider.

Section 5 - Subscription Orders

By purchasing a subscription you authorise That's Them to charge your payment method on a recurring basis at the frequency corresponding to your selected subscription tier - monthly, every two months, or every three months as applicable.

Your subscription will continue and automatically renew until cancelled. You may pause, modify or cancel your subscription at any time after your first order has been fulfilled through your Katching customer portal, accessible via the link in your subscription confirmation email.

Cancellation of your subscription does not automatically generate a refund for orders already shipped and received. Please refer to our Return and Refund Policy and Purchase Options Cancellation Policy for full details.

That's Them reserves the right to modify subscription pricing with reasonable notice to you prior to any price change taking effect. Your continued use of the subscription after a price change constitutes acceptance of the new pricing.

Section 6 - Shipping and Delivery

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing or events outside our control.

Once we transfer products to the carrier, title and risk of loss passes to you. That's Them currently ships within the United States only. Free shipping is available on all subscription orders and one-time purchases of three or more containers, as specified on our website.

Section 7 - Intellectual Property

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement thereof, are owned by That's Them, its affiliates or licensors and are protected by US and international patent, copyright and other intellectual property laws.

Any dispute, claim or controversy arising out of or relating to these Terms of Service or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in the State of Delaware before a single arbitrator. The arbitration shall be administered by the American Arbitration Association under its Consumer Arbitration Rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the fullest extent permitted by law, no arbitration or proceeding shall be joined with any other, no class arbitration proceedings shall be permitted, and no dispute may be brought as a private attorney general action.

Nothing in this Section shall prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
